That's definitely your opinion, I can't say I agree and you oddly took the messages out of context while insisting they already were.
Do you know what a motion to dismiss is, by the way?
Won't they get those fees back if dismissed or if the plaintiff doesn't prevail?
My understanding is that this is generally not the case in the US.
